Non-Compliance of Student Worker Policies (Time Worked)

Goal:

To provide guidance for non-compliance with Student Worker Policies regarding work hour limitations (cap) and accurate reporting of paid service hours worked.  

“Paid Service Hours shall mean each hour for which the individual is paid or entitled to payment for the performance of his or her duties as directed or assigned as paid service by their supervising faculty or staff member. “Paid service hours” do not include independent, unpaid effort required to maintain academic progress, professional development, or to complete a dissertation or thesis. Hours devoted to academic progress are not capped.

Types of Student Workers:

Graduate Student Workers:

Hourly, Summer:

  • Cap:  28 paid service hours per week.  Reference different cap below for international student workers.
  • Report hours worked through timekeeping system used for payroll processing.  No additional reporting of time is necessary.

Graduate Assistants:

  • Cap:  28 paid service hours per week.  Reference different cap below for international student workers.
  • Must track cumulative paid service hours worked per day effective 10/4/2013 in the Tracking system (not for compensation purposes).  The method used for payroll processing remains the same.  

International Student Workers:

  • Federal law 8CFR214.2(f) limits international student employees to a maximum of 20 work hours per week while classes are in session. This includes both graduate and undergraduate international student employees.
  • Supervisors cannot require nor allow international students to work greater than 20 work hours per week. It is important to keep close track of the work hours of international student employees so that they do not exceed the 20 work hour per week maximum. Federal law 8CFR274(a)(10) imposes penalties and fines on employers and supervisors who violate the law. Additionally, non-immigrant international students who accept unauthorized employment can be subject to deportation. Undergraduate Student Workers:

Undergraduate:

Undergraduate Resident Assistants:

  • Cap 28 paid service hours per week.  Reference different cap above for international student workers.
  • Must track cumulative paid service hours worked per day effective 10/4/2013 in the Tracking system (not for compensation purposes).  The method used for payroll processing remains the same.

Responsibilities:

Student Workers

  • It is the responsibility of all Student Workers:
    • Not to exceed the cap on paid service hours worked per week, and
    • To accurately report paid service hours worked.

Supervisors

  • It is the responsibility of Supervisors:
    • To enforce compliance of their direct reports.

Disciplinary Action:

Student Workers:   Any student worker found violating the policies will be disciplined for their offense in a manner consistent with the Clemson University Discipline Policy.

Supervisors:   Supervisors will be subject to disciplinary action if they fail to follow the University policies.
